Luba intent to appeal the applicant has proposed a 2-parcel partition, as shown on the attached preliminary plan (exhibit c. 1). The primary issues identified with this proposal are: narrow lot provisions tree preservation demolition, sewer capping, and cesspool decommissioning right-of-way dedication and frontage improvements fire bureau requirements for fire flow, hydrant spacing, addressing and aerial access. Additionally, there were neighborhood concerns about the scale of the proposed development. As discussed in this report, some of the relevant standards and approval criteria have not been met, including those related to lot dimensions (criterion a), tree preservation (criterion b), easements (criterion h), and transportation impacts (criterion k). Therefore, the applicant has not met the burden of proof (33. 800. 060), which requires the applicant must show that the approval criteria are met.
