The retaining wall at my property line has no structural damage. My property does not have a deck or any other addition in the rear that could create differential settlement or otherwise impact the wall. I am not responsible for fixing something the has been damaged by construction of structures on other properties. Furthermore, repairs were made to a portion of the wall in the 1950s, but the city has not conducted research to obtain information on these repairs and if they may be the cause of the current deterioration of the wall. In addition, there has been no investigation into whether all of the structures above the wall were permitted and inspected by the city, or if the prior repair to the wall was permitted. Before any liability is assessed, these issues must be thoroughly investigated and resolved, and the cause of the damage must be considered.
