Contacted property owners agent and explained to applicant section 7-8-4 (f)(5) of the unified development ordinance requires a minimum side setback of six feet (6) from side property boundary lines in the rs-8 district. Existing building non-conforming as the footprint already encroaches within minimum required side setback. Explained new deck addition and stairs would have to be designed and constructed to meet minimum required setback. Also explained right to appeal of file for a variance. Applicant submitted site plan shows four feet (4) from both the left and right side property boundary.
